Terms of Service

These Terms of Service ("Terms") are an agreement between you and Federico Picchianti, a sole proprietorship registered in Italy (VAT number IT16850481009), Via Pisino 93, 00177 Rome, Italy ("we," "us," "our"), the provider of FP AI. By creating an account, starting a free trial or using FP AI, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use FP AI.

1. What FP AI is

FP AI is an AI relationship coach for women, built on the coaching method of Federico ("Fred") Picchianti. You chat with it in writing, with voice notes or with screenshots, and it remembers your situation over time, so it can give you a straight read on what's going on and your next move.

FP AI is an AI, not a person. It is not Fred and not a human coach, and no person writes its replies. Fred doesn't answer your messages in FP AI: the AI writes the replies, except fixed safety messages we wrote in advance. The app reminds you that you're chatting with an AI when you start, and at least every 3 hours while you keep chatting. If you ask FP AI whether it's an AI, it will tell you.

2. What FP AI is not

Not medical care, mental health care or counseling. FP AI doesn't diagnose, treat or cure anything, and it doesn't replace a doctor or a licensed professional.
Not an emergency service. FP AI can't call for help or contact anyone for you.
Not legal, financial or other professional advice.
Not a guarantee. FP AI gives you its best read and a next move. It can't promise how another person will act, including whether someone will text you, come back or commit.

FP AI's replies are generated automatically. They can be wrong, incomplete or out of date. You decide what to do with them, and your choices are your own.

3. Safety comes first

If you're in danger or thinking about hurting yourself, stop using FP AI and talk to a real person now:

Immediate danger: call 911.
Thoughts of suicide or self-harm, or emotional crisis: in the US and Canada, call or text 988.
Someone is hurting or threatening you: National Domestic Violence Hotline, 1-800-799-7233.
UK and Ireland: Samaritans, 116 123.
Australia: Lifeline, 13 11 14.
Anywhere else: your local emergency number.

When FP AI detects signs of a crisis, it doesn't coach on that message: it shows these resources instead. Read how this works on our Safety page.

Companion chatbots may not be suitable for some minors.

4. Who can use FP AI

You must be 18 or older. When you create your account, you confirm you are. If our safety checks find that something you write suggests you're under 18, FP AI stops coaching and your account is put on hold until our team reviews it. If we confirm that an account belongs to someone under 18, we close it and delete its data. If you're 18 or older and your account was put on hold by mistake, email us and we'll review it.
Accurate information. Use your own email address and give us accurate information.
One person per account. Your account is personal: don't share it, sell it or transfer it.
Personal use. FP AI is for your own personal use, not for providing services to others.

5. Your account and sign-in

You sign in with your email address and a one-time code we email you. There is no password.
Keep your email account secure: anyone who can read your email can sign in to FP AI. Tell us right away if you think someone else got into your account.
You stay signed in on a device until you sign out or your session expires.
When you sign in, and about every 12 hours after that, we check that your subscription is active. If it isn't, you'll be signed out.

6. Subscription, free trial and billing

Price and free trial

FP AI is a monthly subscription: 14 days free. Then $29 a month until you cancel. Cancel in the first 14 days and you pay $0. If your checkout showed a different price, that price applies. Prices are in US dollars. [TO BE CONFIRMED: how taxes are shown and charged.]
To start the free trial, you add a payment method. If you don't cancel before the trial ends, your paid subscription starts automatically: you're charged the monthly price when the trial ends, and then every month on the same date, until you cancel.
Free trials are for new subscribers, one per person.

Cancel anytime

You can cancel at any time, online, from Manage my subscription, which is also in the FP AI menu. Choose where you subscribed: if you subscribed on Whop, it takes you to your memberships on Whop, where you can cancel; if you subscribed on Fred's website (fredpicchiantidynamics.com, which runs on Kajabi), it takes you there to sign in, and you'll find your subscription under Subscriptions in your account. You can also email supporto@federicopicchianti.com and we'll cancel it for you.
If you cancel during the free trial, you won't be charged.
If you cancel after a payment, your subscription stays active until the end of the month you've paid for, and then stops. You won't be charged again.
Deleting your FP AI account does not cancel your subscription. Cancel it separately.

Payments and refunds

Payments are processed by Whop, which acts as merchant of record for card payments, or, for some earlier subscriptions, by Kajabi. Their payment terms also apply. We remain the provider of FP AI and responsible for it under these Terms. We never see your full card number.
Payments are non-refundable, except where the law requires a refund or where we decide otherwise. If you think you were charged by mistake, write to us.
If a payment fails, we may pause your access until it's fixed.

Price changes

We may change the price in the future. Before a new price applies to you, we'll email you the new price and how to cancel [TO BE CONFIRMED: notice period, between 7 and 30 days]. If you don't want to pay the new price, cancel before it applies.

7. Daily usage limit

Your subscription includes a daily usage limit, which keeps FP AI fast and sustainable for everyone.
The limit resets every day at midnight Eastern Time (New York time).
Some things use more of your daily allowance than others: longer, more detailed replies, screenshots and voice notes use more than a quick reply.
When you reach the limit, FP AI pauses until the reset. There are no credits, top-ups or packs to buy. Unused allowance doesn't carry over to the next day and has no cash value.
The safety message (section 3) is always available, even if you've reached the limit. At the limit voice notes can't be processed: type your message instead.
We may adjust the limit to keep FP AI sustainable. If we lower it significantly, we'll tell you in advance.

8. Your content

What you write, say and upload in FP AI is yours ("your content").
You allow us to store, process and transmit your content, including through the providers listed in our Privacy Policy, only as needed to run FP AI for you, to keep it safe and to comply with the law. When you give a reply a thumbs up, you also allow us to turn that exchange into a general coaching rule without your personal details, as the Privacy Policy explains.
You confirm that you have the right to share what you upload, and that it doesn't break the law or anyone else's rights.
FP AI's replies are for your personal use. Because they're generated by AI, other people may get similar replies.

9. Content about other people

You'll often talk about other people and upload screenshots of their messages. You're responsible for what you share. Share only what you need, for your own personal purposes, and hide names, phone numbers and faces when you can.
Don't use FP AI to monitor, track, stalk, harass, threaten, expose or hurt anyone, or to get around a court order.
Don't upload intimate or sexual images of anyone.

10. Acceptable use

You agree not to:

break the law, or help anyone else break it;
upload or ask for any sexual content involving minors. We report apparent child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and to the authorities, as the law requires;
upload content that is threatening, hateful or defamatory, or that violates someone else's privacy or rights;
try to get around the daily limit, the safety features or our security, including by scraping, automated access, reverse engineering or overloading FP AI;
share, sell or resell your account or access to FP AI;
pretend to be someone else, or lie about your age;
use FP AI to build a competing product or to train AI models.

11. Our intellectual property

FP AI, its software, design and texts, the coaching method and materials behind it, and the FP AI name and logo belong to Federico Picchianti or to our licensors. We give you a personal, limited, non-exclusive, non-transferable and revocable license to use FP AI under these Terms. Nothing else is transferred to you.

12. Availability and changes to FP AI

FP AI depends on technology and providers we don't control. We work to keep it running, but at times it may be unavailable, slow or make mistakes. We may change, add or remove features. If we decide to shut FP AI down for good, we'll tell you in advance when we can, stop charging you and [TO BE CONFIRMED: refund the unused part of your current paid month].

13. Suspension and closing your account

You can stop using FP AI at any time: cancel your subscription and, if you want, delete your account in the app.
We may suspend or close your account if you break these Terms, if you appear to be under 18, if your payment fails, if the law requires it, or to protect other people or the security of FP AI. When we can, we'll tell you why.

14. Disclaimers

TO THE FULLEST EXTENT ALLOWED BY LAW, FP AI IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T PROMISE THAT FP AI WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT ITS REPLIES WILL BE ACCURATE OR RIGHT FOR YOU, OR THAT YOU WILL GET ANY PARTICULAR RESULT.

Some states don't allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

15. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA OR THE OUTCOME OF YOUR RELATIONSHIPS, ARISING FROM YOUR USE OF FP AI OR FROM DECISIONS YOU MAKE BASED ON IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO FP AI IS LIMITED TO THE GREATER OF WHAT YOU PAID US FOR FP AI IN THE 12 MONTHS BEFORE THE CLAIM AND $100.

These limits don't apply where the law doesn't allow them, including for our fraud, gross negligence or willful misconduct. Some states don't allow these limits, so they may not apply to you.

16. Indemnity

If you use FP AI in breach of these Terms or the law, or upload content that violates someone else's rights, you agree to cover the reasonable costs, including reasonable legal fees, of claims that others bring against us because of it, to the extent the law allows.

17. Changes to these Terms

We may update these Terms. For important changes, we'll tell you by email or in the app at least [TO BE CONFIRMED: 30] days before they take effect. If you keep using FP AI after that date, the new Terms apply. If you don't agree, cancel your subscription and stop using FP AI before then. Changes never apply to disputes that started before them.

18. Disputes and governing law

Talk to us first. If you have a problem with FP AI, email supporto@federicopicchianti.com. We'll try to solve it with you informally within 30 days.

Nothing in these Terms takes away the protections that the consumer laws of the place where you live give you and that can't be waived by contract.

19. Electronic communications

You agree that we may send you notices and other communications about FP AI electronically, by email or in the app, and that they count as "in writing."

20. General

Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about FP AI.
Severability. If a court finds part of these Terms invalid, the rest stays in effect.
No waiver. If we don't enforce one of our rights immediately, we haven't given it up.
Transfer. You can't transfer your rights under these Terms. We may transfer them as part of a sale or reorganization of FP AI, and your rights stay protected.
Events beyond our control. We're not responsible for delays or failures caused by events beyond our reasonable control.
Language. These Terms are written in English, and the English version applies.
